On December 21, 2021 Attorney General Merrick Garland issued this statement in reference to today’s Office of Legal Counsel opinion on home confinement. The opinion essentially rescinds OLC’s prior order requiring those released to home confinement pursuant to the CARES Act to return to prison once the pandemic emergency is over, now allowing for discretion.
