Yesterday, the House Judiciary Committee unanimously reported out H.R. 5283, the Deterring Undue Enforcement by Protecting Rights of Citizens from Excessive Searches and Seizures (DUE PROCESS) Act of 2016. A manager’s amendment making technical fixes to the bill was adopted and is attached. No other amendments were offered.
The ACLU writes that due process provides important procedural protections for those subjected to forfeiture, but does not address the profit incentive driving forfeiture.
